Tuesday’s episode of “The View” turned tense when co-host Joy Behar reacted sharply to a fellow panelist’s prediction of former President Donald Trump’s victory in the 2024 elections. The panel’s discussion, sparked by Trump being removed from the Colorado and Maine ballots, led to a significant clash of opinions.
Sara Haines expressed her belief that the decision of Trump being on the ballot should rest with the voters. “I don’t think the Supreme Court’s going to hold this. I think they’re going to overturn it and it won’t just be the originalists. I bet it’s a 9-0 vote… I think they should leave it to the voters.”
The opinion then visibly angered co-host Joy Behar, who interjected with, “So what are you saying?” and “Oh no.”

The Supreme Court is expected to hear disputes over Trump’s role in the events leading up to the January 6, 2021, breach on the U.S. Capitol. One of the crucial cases involves Trump’s appeal against a decision by Colorado’s top court, which disqualified him from appearing on the state’s primary ballot.
The ruling is part of a broader effort to challenge Trump’s eligibility under Section 3 of the 14th Amendment of the U.S. Constitution, which bars anyone engaged in “insurrection or rebellion” from holding federal office.
Colorado and Maine are the only states thus far to disqualify Trump from their ballots out of 32 states where his eligibility has been contested. The Supreme Court’s handling of Trump’s appeal in the Colorado case could significantly influence similar efforts in other states.
Additionally, the Supreme Court has been involved in the criminal prosecutions facing Trump. Special Counsel Jack Smith has urged the justices to rule on Trump’s claim that he cannot be prosecuted for trying to overturn his 2020 loss to President Joe Biden.
The request followed a federal judge’s rejection of Trump’s immunity bid, and Smith asked the Supreme Court to decide the issue even before a lower appeals court rules on it, a highly unusual request.
In December, shortly after the initial ruling, Behar wrote on Twitter, “Joe, the ballot box can’t compete with the third party candidates who will take votes from Joe Biden. And let us not forget the electoral college. The law must defeat him.”

Joe Walsh, in his initial tweet, expressed his reservations about the ruling against Trump. While he believed Trump committed insurrection, he noted that the former president hadn’t been formally convicted, calling into question the validity of using such a basis to bar him from office.
“The best and ONLY way to defeat Trump is at the ballot box, not to kick him off the ballot,” Walsh wrote. “Defeat him at the ballot box. That’s what’s best for the country.” The backlash at Behar was particularly notable given her previous claim that a Trump primary victory would lead to a Democratic win.
