Late night host and alleged comedian Stephen Colbert transformed into a legal analyst earlier this week when defending the Colorado Supreme Court’s unprecedented decision to remove former President Donald Trump from the state’s election ballot. Colbert compared the former president to the confederacy and claimed the case was a “gimme” since Trump violated the 14th Amendment.
Despite the fact that the vast majority of legal scholars — including those who have become noted critics of the president — have predicted that the ruling will be thrown out by the U.S. Supreme Court, Colbert explained how the case was a “gimme” to cheers and applause from his audience.
“You can feel it in the air, folks. There are just five days until Christmas. But Santa came early last night when the Colorado Supreme Court ruled that Donald Trump is disqualified from holding office,” Colbert began as the crowd burst into applause. He then joked that the ruling “shows you can make good decisions when you’re high,” adding that the Democrat-appointed justices had “munchies for justice.”
“Can you imagine how mad Donald Trump must have been when he heard the news. Oh, to be a ketchup stain on his wall,” he added.
“Notably, the people over at Fox News have their catheters in a twist over this,” the late night host continued, drawing laughter from the audience. Colbert then transformed into a legal scholar before quoting the 14th Amendment, which bars former officers of the United States who have engaged in “insurrection” from running for office.
Trump has not been charged with, much less convicted of, inciting an “insurrection” on January 6, 2021.
Despite this, Colbert cited “conservative judge” and frequent MSNBC contributor J. Michael Luddig while arguing that Trump is disqualified under the 14th Amendment.
“Anti-democratic. That’s like saying… That’s like saying it’s anti-hen to keep the fox out of the hen house. Let the chickens decide whether he finds them delicious,” Colbert said, once again drawing laughs. “And let’s be clear here, the Colorado Supreme Court did not kick Trump off the ballot. The United States Constitution kicked Trump off the ballot.”
“Yes, the 14th Amendment says if you try to destroy our democracy, you can’t come back and try again. It’s the same reason I’m not letting my appendix back into my abdomen, no matter how well it holds in Iowa,” he continued as the crowd erupted into its loudest applause yet. “How’s my appendix doing in Iowa?”
